Waiver of Liability

Saratoga Furst Day 5K Waiver *BY SIGNING THIS WAIVER, YOU AGREE THAT THIS SATISFIES YOUR AGREEMENT FOR THE SARATOGA FIRST DAY 5K. WAIVER I understand that through my participation in this event and activities (collectively "The Event") I may be engaging in activities that involve the risk of serious personal injury, illness, permanent disability, and death and that such participation may also involve the risk of severe economic and property loss and damage. I hereby certify that I am mentally cognizant, physically fit for participation in this event, sufficiently trained, have the skill level required to compete in this event and have not been advised otherwise. I assume all the risks associated with participating in this event, including but not limited to falls and other contact with other participants, the effects of weather including hypothermia or heat related illness, traffic and the conditions of the course. I know that running is a potentially hazardous activity, which could result in injury or death. I acknowledge that I am participating in the activity outlined by this event by my own free will and at my own personal risk. I will not participate in this event unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform this event, and am in good health, and I am properly trained. I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the race , including the terms in this waiver, and agree to abide by them. I assume all risks to me associated with running as part of this activity, including but not limited to: falls, contact with other participants, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road or trail, all such risks being known or unknown and appreciated by me. Having read this waiver and in consideration of your acceptance of my entry, I for myself and anyone acting on my behalf, and my heirs waive and release FC4,Inc., Raven Events, the City of Saratoga Springs, the Saratoga Springs City Center, Peak Output Events, LLC, all event sponsors, event volunteers and public safety and service providers, including their representatives, officials and successors from all claims or liabilities of any kind arising out of my participation in this Event, or any of my minor children even though liability may arise out of negligence or carelessness on the part of the organizations or individuals named in this waiver. I also understand that wearing headphones, ear buds or other listening devices during this event is prohibited and that skates, skateboards and animals are not permitted at the Event. Further, I understand that incomplete or unsigned entries cannot be accepted. The sale and/or transfer of race entries/bib numbers is strictly prohibited. Further, I hereby grant full permission to any and all of the foregoing to use any images, photographs, videotapes, motion picture recordings, or any other record of this event for advertisement, or other legitimate purposes. City of Saratoga Springs Participant Assumption of Risk and Waiver/Release For Injuries, Damages, and Claims I hereby acknowledge that my participation in the aforementioned event carries with it the potential for death, serious injury and/or property loss. I hereby expressly assume all risk of injury and damage and release the State of New York, New York State Department of Transportation, and the City of Saratoga Springs, NY from all liability and claims of whatever nature or cause which may occur as a result of my participation in this event. I further acknowledge that “No person or entity shall have the right to bring an action against the State, the City of Saratoga Springs, NY or any person employed by the State, or the City of Saratoga Springs, NY who was acting within the scope of his authority, for damages resulting from or in connection with any such race, contest or exhibitions.” Refund Policy Registration fees and Event purchases are non-refundable. The entry fee for this year's event will NOT transfer to next years event without the prior permission of FC4 Inc. Please note that the Event organizers reserve the right to reject any entry for any reason. We adhere to USATF race rules and requirements. If adverse or unexpected conditions warrant, the organizers reserve the right to delay, postpone or cancel this event. Waiver Signature You must be over 18 years of age OR the parent/legal guardian of a minor under 18 years of age OR the legal guardian of an incapacitated and/or mentally challenged person in order to agree to the waiver above.
